Alec Baldwin Charged Again: The New Legal Battle of the ‘Rust’ Shooting

Renowned actor Alec Baldwin has again found himself at the center of legal proceedings. This is because the New Mexico grand jury has decided to press charges against Baldwin, which include two counts of involuntary manslaughter, both classified as fourth-degree felonies.

Attorney Ugo Lord provides his legal analysis of the charges against Alec Baldwin.

Details of the Charges

The first count of involuntary manslaughter is related to the negligent use of a firearm. The second count pertains to involuntary manslaughter committed without due caution or circumspection.

This marks a significant development in the aftermath of the tragic incident that unfolded in October 2021, resulting in the untimely death of cinematographer Halyna Hutchins.

The latest indictment accuses Baldwin of causing Hutchins’ death through an act committed with total disregard or indifference for the safety of others. This comes after the firearm Baldwin was handling discharged a .45 bullet during an on-set rehearsal, fatally striking Hutchins. The unexpected firing of the antique six-shooter also led to director Joel Souza sustaining a shoulder injury.

Baldwin, who also served as an executive producer and co-writer on “Rust,” has consistently maintained his innocence. He stated that he did not intentionally pull the trigger. However, the FBI’s ruling contradicts his claim, saying that the revolver could not have fired without the trigger being clipped.

Parties Involved in the Incident

Hannah Gutierrez-Reed was charged for overseeing the weapons on the movie set

In addition to Baldwin, the legal proceedings have extended to other individuals involved in the production. The film’s armorer, Hannah Gutierrez-Reed, has also been charged with involuntary manslaughter. Prosecutors have alleged that Gutierrez-Reed, responsible for overseeing the weapons on the movie set, may have been under the influence of alcohol and marijuana during filming and possibly hungover at the time of the shooting. She has pleaded not guilty and is awaiting trial.

David Halls, the first assistant director on the film, was handed a sentence of six months of unsupervised probation. Halls was identified as the person who handed the revolver to Baldwin before the shooting.

Impending Trial

The potential legal consequences for Baldwin are significant, as he could face up to 18 months in prison if convicted. The trial for Gutierrez-Reed is scheduled to commence in February. Interestingly, Baldwin will not be called to testify in her case.

Meanwhile, the family of Halyna Hutchins continues to seek truth and accountability through a civil lawsuit, and they eagerly anticipate the criminal trial to determine if Baldwin should be convicted for the tragic loss of their loved one.

The revival of the criminal case against Baldwin has reignited public interest in the events surrounding the “Rust” shooting, underscoring the gravity of the legal proceedings and the profound impact of the tragedy on all involved. The ongoing developments in this case continue to captivate the attention of the public and the entertainment industry.
